This privacy policy (hereinafter the "Policy") aims to explain the rules surrounding the various personal data processing activities that may be implemented when you use our website accessible from the URL: www.humility.fr (hereinafter the "Site").

As the data controller of your Personal Data, HUMILITY makes every effort to best protect your privacy during your visits to the Site.

This Policy allows you to learn more about the origin and use of your Personal Data as well as your browsing information processed during your consultation of our Site.

1. Protection of your personal data

In accordance with the Regulations, HUMILITY records all processing activities it carries out in a processing register that we make available to the CNIL. All information you may have provided to HUMILITY during your visits to the Site is strictly confidential. This information is necessary for the purpose of their processing.

1.1. What Personal Data is collected and processed?

The information that may be collected and processed is as follows:

- Identification and contact data: your first name, last name, date of birth, gender, postal address, delivery address, phone number, email address, language, and the country from which you interact with us;

- Financial and payment data: your bank details (in this regard, we inform you that all payment transactions are encrypted by the receiving bank and that we do not store any card numbers), information about your purchases, orders, returns, etc.;

- Login data (such as your username and password), geolocation data (only with your consent), and browsing data (if you use the "find a store" service, for example); and

- Personal preferences: this includes your cookie preferences.

When we ask you to enter your personal data to access a feature, some data fields are mandatory because they are necessary to allow you to access that feature (for example, to deliver a package we need your postal address).

It is important that the personal information you share about yourself is accurate and up to date. Therefore, we kindly ask you to update your information in case of any changes.

We do not process any personal data that could be classified as "sensitive" (information concerning racial or ethnic origin, political, philosophical or religious opinions, trade union membership, health, or sexual life) under data protection regulations.

In this regard, it is specified that our Site is not intended for children and therefore we do not process any data related to them.

We commit not to transfer your personal data to third parties except for the exceptions listed below in Article 1.3.

1.2. For what purposes are your personal data collected and processed?

The Personal Data listed above may be collected and processed for the following purposes:

  • Registration Management on our Site

To access certain features on our Site, you will need to register by creating an account; your data is therefore used to create the account. You can delete your account on our Site at any time.

  • Order Management

Processing your data is necessary to keep you informed about the status of your order, prepare your order, accept your payment, give you access to after-sales service, and manage returns of your orders.

  • Access to customer service

We process your data as part of our customer service to respond to your requests.

  • Improvement of our services

We process your browsing and purchase data for analysis and statistical purposes. Indeed, this data allows us to analyze how you use our Site and improve its ergonomics and quality.

  • Marketing

As part of your subscription to our newsletter, we process your data to manage your subscription, send you targeted information by email or SMS according to your preferences, or track your interactions with our content (email openings). We may also contact you via push notifications if you subscribe to this service.

Processing for marketing purposes requires your consent. You can unsubscribe from our communications at any time.

If you have given us your consent to receive our communications, whether via our newsletter or push notifications, we may use the information you provided for the following purposes:

- Sharing information about our events, products, services, and current offers;

- Recommendations on certain products or services that may interest you; and

- Customer studies to better understand your expectations regarding the products and services offered on our Site.

1.3. Who are the recipients of your Personal Data?

When using our Site, you may receive information from third parties with whom we collaborate to offer you certain services. This may include:

- From financial institutions;

- From fraud detection and prevention entities;

- From logistics, transport, and delivery services; and

- From marketing and advertising service providers.

Personal Data is collected by HUMILITY.

However, we may share your information with the third parties listed above, notably for the following reasons:

- process payment regarding financial institutions;

- deliver your order regarding logistics, transport, and delivery services;

- verify your credit and identity regarding fraud detection and prevention entities; and

- optimize your shopping experience on our Site regarding marketing and advertising service providers.

We require third parties receiving your personal data to commit to complying with data protection regulations. The third parties listed above may only use your personal information according to our instructions and not for their own use.

Your connection and browsing data may also be transferred to Google Analytics.

HUMILITY may also disclose your Personal Data to comply with a legal order from authorities.

HUMILITY does not transfer any of your Personal Data outside the European Union.

1.4. How long is your Personal Data retained?

We will keep your data as long as you remain a customer and also for a period of ten (10) years following your last order, in order to respond to any questions, complaints, or to maintain all necessary data to comply with legal, accounting, or analytical requirements (Article L.123-22 of the Commercial Code).

We may also retain your data for research or statistical analysis; this data will then be anonymized.

As part of a subscription to our newsletter, we will no longer contact you if you have not opened our newsletters for more than twelve (12) months.

Any changes to this Policy will be made on this page and, if applicable, notified to you by email.

HUMILITY may also retain your data for research or statistical analysis. Since this data is anonymized, no retention period is imposed by regulations as it is no longer possible to "re-identify" you afterward.

1.5. Hosting of your Personal Data

HUMILITY operates in various countries, but your personal data is only stored on secure servers located in Europe.

 However, in order to provide certain services, HUMILITY may need to transfer your data through servers that may be located worldwide or grant access to personal data to service providers located abroad. HUMILITY will naturally take appropriate measures to maintain the security of personal information during the transfer and upon receipt of this information. Subcontractors and service providers will be contractually bound to HUMILITY, which will include standard contractual clauses (as published by the European Commission). Furthermore, HUMILITY requires its subcontractors and service providers to guarantee a sufficient level of security, confidentiality, and protection of privacy and fundamental rights.

1.6. What are your rights?

1.6.1. Consent

Your consent must be given clearly and unambiguously. That is why, when you agree to fill out the Site’s contact form:

- you are informed about the use that will be made of your Personal Data;

- you must check a box to validate your consent; and

- children under 13 years old cannot give their consent.

1.6.2. Other rights

In accordance with the Regulation, you have the following rights regarding your Personal Data:

- Right of access to data: this right allows you to receive a copy of the Personal Data we hold about you;

 - Right to rectification: this right allows you to request the correction of inaccurate or incomplete Personal Data concerning you;

 - Right to deletion of your Personal Data: this right allows you to request the deletion of your Personal Data if one of the legal grounds is met:

  • the Personal Data is no longer necessary in relation to the purposes of the processing;
  • you have withdrawn your consent on which the processing is based;
  • you have objected to the processing through your right to object;
  • the processing of your Personal Data is unlawful; or
  • your Personal Data must be erased under a legal obligation.

 - Right to restriction of processing of your Personal Data; this restriction can be applied when:

  • you contest the accuracy of your Personal Data;
  • you do not object to the deletion of your Personal Data in the case of unlawful processing but request that it be restricted;
  • your Personal Data is no longer used by our services but their retention is only necessary for the establishment, exercise, or defense of a legal claim; or
  • you object to our use of your Personal Data through your right to object.

 - Right to data portability: you can contact us to have your Personal Data provided to you or directly to another data controller in a structured, commonly used, and machine-readable format;

  • The processing is carried out to fulfill a public interest mission or for the purposes of our legitimate interests; you may object only for reasons related to your situation; or
  • the processing is carried out for commercial prospecting purposes; you can object at any time without giving any explanation.

 - Right to determine the fate of your Personal Data after your death (the e-Testament): one of the specificities of French regulations is that it allows you to give us your directives

regarding how we will handle your Personal Data after your death. In this respect, you can choose to have it deleted or transmitted to one of your relatives.

Regardless of the purpose or legal basis under which we process your data, you can at any time and at no cost send us an email to exercise your rights at the following address: rgpd@humility.fr

Or send us a letter at the following address:

If you are registered on our Site, you can also modify your Personal Data from your account by logging in with your email address and password.

In any case, we remind you that you have the right to file a complaint with the CNIL.

1.7. What Are the Legal Bases for Processing?

For processing your data, we rely on legal bases depending on how you interact with our Site.

When you purchase products from our Site, we collect and process your personal data to execute the contract between us. For example, we need your postal address to deliver your order or your bank details to process payment.

We also rely on other legal bases such as your legitimate interests. For example, we consider it in your interest that your identity cannot be used fraudulently, that our customer service team has access to your order information to better serve you, or that we can better understand your use of our Site to improve its usability and the services we offer you.

Finally, when it comes to processing Personal Data for the purpose of prospecting, the legal basis for processing is your consent (see above Article 1.6.1.).

  1. Internet Browsing Security

2.1. Integrity of Your Data on the Internet

The Site has appropriate security measures in place to prevent any loss, unauthorized use or access, alteration, or disclosure of your Personal Data.

All personal data collected is stored on secure servers. HUMILITY has also implemented procedures to manage any personal data breaches.

2.2. Malicious Uses

It is recommended that you connect only to secure networks, preferably private networks. Be aware of the risks involved when using public wifi networks.

Regardless of HUMILITY to whom you have voluntarily provided your Personal Data and given the nature of the Internet, other operators, with no connection to HUMILITY, may intercept this data without your consent, especially while browsing the Internet. Therefore, we recommend installing antivirus and anti-spyware software on your computer and keeping them regularly updated.

2.3. Identity Theft/Phishing

HUMILITY will never contact you by email to request personal information.

If you receive an email in the name of HUMILITY asking you to provide sensitive personal information (bank details, private life data, etc.), please do not respond and forward this email to us so that we can take the necessary actions.

You should only provide information related to your account after logging in to the www.humility.fr site directly through your browser.

  1. Cookie Policy

A cookie is a connection token, that is, a text file that may be saved in a dedicated space on your Device’s hard drive when visiting a website. A cookie allows its issuer to identify the Device in which it is stored during the validity or storage period of the cookie.

When browsing the Site, information related to the navigation of your Device (computer, tablet, smartphone, etc.) may be recorded through cookies installed on your Device, subject to the choices you have made regarding cookies, which you can change at any time.

3.1. What are the cookies issued on our Site used for?

Only the issuer of a cookie can read or modify the information contained in it.

When you log in to the Site, HUMILITY may, subject to your choices, install various cookies on your Device that allow the browser of your Device to be recognized during the validity period of the relevant cookie.

Rakuten is a third party that may use site cookies in your privacy policy.

The cookies we issue are used for the purposes described below:

  • to conduct studies and establish statistics and traffic volumes and usage of the various elements composing our Site (sections and content visited, navigation paths), allowing HUMILITY to improve the interest and ergonomics of its services;
  • to adapt the presentation of the Site to the display preferences of your Terminal (language used, display resolution, operating system used, etc.) during your visits to the Site, according to the hardware and viewing or reading software your Terminal has;
  • to remember information related to a form you have filled out on the Site (registration or access to your Member Area) or to products, services, or information you have chosen on the Site (subscribed service, etc.);
  • to allow you to access your Member Area, thanks to identifiers or data you have previously provided; and
  • to implement security measures, for example when you are asked to log in again to content or a service after a certain period of time.

3.2. Your choices regarding cookies

Several options are available to you to manage cookies. Any settings you make may affect your Internet browsing and your access conditions to certain services requiring the use of cookies.

You can choose at any time to express and modify your preferences regarding cookies, by the means described below.

You can specifically configure your browsing software so that cookies are recorded on your Terminal or, on the contrary, rejected, either systematically or according to their issuer.

You can also configure your browsing software so that the acceptance or refusal of cookies is offered to you occasionally, before a cookie is likely to be recorded on your Terminal. For more information, see the section "How to exercise your choices, depending on the browser you use?" in Article 4.2.3. below.

3.2.1. Consent to cookies

The recording of a cookie on a Terminal is essentially subject to the will of the Terminal user, who can express and modify it at any time and free of charge through the choices offered by their browsing software.

If you have accepted the recording of cookies on your device in your browsing software, the cookies embedded in the pages and content you have viewed may be temporarily stored in a dedicated space on your device. They will only be readable by their issuer.

3.2.2. Refusal of cookies

If you refuse the recording of cookies on your device, or if you delete those already recorded, the quality of the services offered by the Site will not be degraded.

However, you will no longer be able to benefit from certain features that may be necessary to navigate some areas of the Site. This would be the case if you try to access content or services that require you to log in. It would also be the case when HUMILITY—or its providers—cannot recognize, for technical compatibility purposes, the type of browser used by your device, its language and display settings, or the country from which your device appears to be connected to the Internet.

 If applicable, HUMILITY disclaims all responsibility for consequences related to the operation of its services resulting from its inability to record or consult the cookies necessary for their operation that you have refused or deleted.

 Please note that some cookies cannot be deleted as they are strictly necessary for the technical operation of the Site.

3.2.3. How to exercise your choices, depending on the browser you use?

For managing cookies and your choices, each browser's configuration is different. It is described in your browser's help menu, which will help you understand how to modify your cookie preferences.

  • For Internet Explorer: http://windows.microsoft.com/fr-FR/windows-vista/Block-or-allow-cookies
  • For Safari:

http://docs.info.apple.com/article.html?path=Safari/3.0/fr/9277.html

  • For Google Chrome:

http://support.google.com/chrome/bin/answer.py?hl=fr&hlrm=en&answer=95647

  • For Firefox:

http://support.mozilla.org/fr/kb/Activer%20et%20d%C3%A9sactiver%20les%20cookies

3.2.4. Delete your cookies

You can delete all your cookies or only those you want. Deleting cookies does not prevent browsing or their reinstallation during browsing. It allows you to control your browser's cookie library at a given time. Technical cookies, necessary for navigation, will be reinstalled if you visit the Site.

 Below, we explain the steps to follow depending on your browser.

Chrome

  • In the Chrome menu, select "Settings"
  • Show advanced settings
  • Go to the "Privacy" paragraph

3.2.5. Private browsing

The "Private Browsing" mode, now offered by all browsers, mainly allows you to browse the Internet without keeping a history of visited pages or downloads. Regarding cookies, all those saved during your browsing will be deleted when you close your browser. This is therefore not a solution to refuse cookies; however, their lifespan is then limited to the duration of your browsing.

3.2.6. Disabling third-party cookies

  • In the window that opened, go to the "Security" tab
  • Optionally, "Accept cookies," select "Only from sites I visit"

3.2.7. Your choices expressed online directly with us

If you do not wish to:

  • that we collect data about your browsing,
  • so that in the context of registration via a special operation we can identify the original special operation, you can choose to disable all third-party cookies that are not essential for browsing the Site.

 We will then store on your device a cookie whose sole purpose is to disable the setting of these cookies on your device. This cookie will be valid for twelve (12) months.

 Please note, honoring your choice relies on a cookie. If you delete all cookies stored on your device (via your browser), HUMILITY—or its providers—will no longer know that you have chosen this option.

List of cookies

A cookie is a small data file (text file) that a website, when visited by a user, asks your browser to store on your device to remember information about you, such as your language preferences or login information. We set these cookies called first-party cookies. We also use third-party cookies, which are cookies from a different domain than the website you are visiting, for our advertising and marketing efforts.
